Both of South Australia's Designated Area Migration Agreements - the Adelaide City Technology and Innovation Advancement Agreement and the South Australian Regional Workforce Agreement - expire on 30 June 2026. That's roughly 100 days from now. A new five-year statewide DAMA is under negotiation between the SA Government and the Commonwealth, but as of March 2026, it has not been signed.

If you're an SA employer sponsoring overseas workers under DAMA concessions, or a worker currently on a DAMA-linked 482 visa, the next three months demand action - not optimism.

What Is a DAMA and Why Does It Matter?

A Designated Area Migration Agreement (DAMA) is a formal agreement between the Australian Government and a state or territory that allows local employers to sponsor overseas workers with more flexible requirements than standard employer-sponsored visas.

South Australia currently operates two DAMAs:

The Concessions You Stand to Lose

SA DAMA concessions are significantly more generous than standard 482/494/186 visa requirements. Here's what's at stake:

WARNING

The age concession is the biggest risk. If you have sponsored workers aged 45-54 who need to transition to permanent residency via the 186 visa, they must be nominated before the DAMA expires. Under standard pathways, they will be ineligible.

ILA Exclusion: Occupations Already Removed (1 July 2025)

Since 1 July 2025, occupations covered by a dedicated federal Industry Labour Agreement (ILA) are no longer accessible through SA DAMA. This means if your industry has its own ILA, you cannot use DAMA concessions - you must use the ILA instead.

IMPORTANT

If you're an SA aged care provider who has been sponsoring workers under DAMA, you should already be operating under the Aged Care Industry Labour Agreement. Your 5-Step Employer Action Plan

Don't wait for the new statewide DAMA to be signed. Here's what you should do now:

Step 1: Audit Your Current DAMA Nominations (This Week)

Review every worker you have sponsored or intend to sponsor under SA DAMA:

  • How many rely on the age concession (workers aged 45-54)?
  • How many rely on the TSMIT reduction (salary between $68,864 and $76,515)?
  • How many rely on English concessions (below IELTS 5.0 in each band)?
  • Are any nominations still pending endorsement from the SA Government?

Step 2: Fast-Track 186 Nominations for At-Risk Workers (By May 2026)

Workers aged 45-54 are the most vulnerable. If they have completed two years on a 482 visa under DAMA:

  • Lodge the 186 ENS (Employer Nomination Scheme) nomination before 30 June 2026
  • Ensure the nomination references the current DAMA and its age concession
  • Do not assume a new DAMA will have identical concessions

Step 3: Assess ILA Alternatives for Excluded Occupations

If your occupation was removed from DAMA on 1 July 2025, you should already be on an ILA. If not:

  • Use our ANZSCO Occupation Search to confirm your exact occupation code and current visa eligibility
  • Identify which Industry Labour Agreement covers your industry
  • Apply to become an approved sponsor under the relevant ILA
  • Note that ILA concessions differ from DAMA - some are more generous, some are not

Step 4: Prepare Contingency Plans (If No New DAMA by 1 July 2026)

If the new statewide DAMA is not signed by 30 June 2026, your options are:

Step 5: Get Professional Advice Now, Not in June

The worst outcome is discovering in late June that your worker cannot transition to PR because the DAMA has expired and no replacement is in place. As explained in our general DAMA visa guide, these agreements are complex. A registered migration agent can:

  • Identify which workers need urgent 186 nominations
  • Prepare ILA applications if applicable
  • Develop a contingency strategy for the gap period
CAUTION

Do not assume the new DAMA will be signed on time. Government negotiations can and do overrun. Even if a new DAMA is signed, its concessions, occupation list, and terms may differ from the current agreements. Plan for the worst case.

What Happens to Workers If DAMA Expires?

If you're an overseas worker currently on a 482 visa sponsored under SA DAMA:

  • Your visa remains valid - a DAMA expiry does not cancel existing visas
  • Your 186 nomination must reference the DAMA - if you need the age or English concession, the nomination should be lodged before the DAMA expires
  • Talk to your employer - ensure they are aware of the deadline and have a plan
  • You can check your visa conditions to understand your current entitlements
