澳洲移民法對伴侶(配偶)簽證的重要法律條文定義

澳洲移民局在審裡伴侶簽證時，需要根據澳洲移民法 Migration Act 1958 (Cth) 和Migration Regulations 1994(Cth) 來審理，在審理的時候，簽證官必須以澳洲移民法為依據才能有效的決定簽證申請人是否符合申請簽證的資格。

伴侶簽證是一個熱門的家庭類別簽證之一，此簽證是給在澳洲擁有永居身份或者澳洲公民來擔保其伴侶來澳洲的簽證。 通常對伴侶的定義，我們一般會認定為結婚或者同居就是符合伴侶關係，但是申請澳洲伴侶簽證必需要了解澳洲移民法對伴侶關係的定義如何，才能確保自己有申請伴侶簽證的資格。

澳洲移民法對伴侶類別的幾個重要定義

Partner (伴侶)

移民法定義: A spouse, de facto partner or fiancé(e).

移民法認定的伴侶關係必需是配偶，同居伴侶或同居未婚夫妻

Spouse (配偶)

移民法定義:  A person is the spouse of another person if they are in a married relationship.
移民法認定的是否為配偶主要看是否有無合法的婚姻關係。

De facto relationship (同居關係)

移民法定義:

A person is in a de facto relationship with another person if:
they are not in a married relationship with each other;

• they are not related by family (不能有血緣關係;
• they have a mutual commitment to a shared life to the exclusion of all others (一起共同分擔生活並且感情上無法分開彼此);
• the relationship between them is genuine and continuing (關係必須是真實並且持續的);
• they live together or do not live separately and apart on a permanent basis; and (住在一起而且不是永久分居在不同地方)
• the relationship has continued for the period of 12 months immediately preceding the date of application (special circumstances apply). (同居關係必需在遞交申請前維持12個月以上 (其他方式可以有條件豁免)

Married relationship (結婚關係定義)

Persons are in a married relationship if: (必需在以下情況下才符合移民法的結婚關係要求)

• they are married to each other under a marriage that is valid for the Australian Migration Law; (必需在合法結婚並且符合澳洲移民法的婚姻)
• they have a mutual commitment to a shared life as husband and wife to the exclusion of all others; (夫妻之間有一起共同分擔生活並且感情上無法分開彼此)
• the relationship between them is genuine and continuing; and (關係必須是真實並且持續的)
• they live together or do not live separately and apart on a permanent basis. (住在一起而且不是永久分居在不同地方)

Settled (定居要求)

To meet settled requirements, a person must have been lawfully resident in Australia for a reasonable period, usually 2 years. (符合移民局澳洲定居要求，必需在澳洲有居住過一段時間，通常移民局認定的定居時間是2年。)
